Guidelines of Order Processing.

1.   Definitions

  The following terms shall have the following meanings:

Account

means the account created by you on the Website for the purpose of buying the Products;

means .16diamonds.com limited;

Conditions 

means these terms and conditions of business;

Delivery Address

means the address stated on the Order;

Products 

means such Products as are manufactured by or for 16diamonds.com limited;

Order 

means your order for the Products; and

Website

means  www.16diamonds.com limited.

2. Ordering

General

2.1

By submitting the Order for processing, you confirm and affirm that you have read, understood and agreed to be bound by these Conditions in the form in which they appear at the time when the Order is submitted for processing.

2.2

You will be liable for every Order made under your Account and agree to indemnify 16diamonds.com for all claims, liabilities, losses, damages, costs and expenses whatsoever made against or sustained by 16diamonds.com arising from the actions of a third party whether with or without your authorisation placing Orders using your Account.

2.3

You shall be responsible for updating your registration information including your credit card information. You shall be responsible for notifying your bank of any changes to your billing address or other information or loss, theft or unauthorised use of your credit card.

2.4

16diamonds.com shall make every effort to fulfil Orders placed by you through the Website and accepted by  16diamonds.com, but 16diamonds.com shall not be liable to any person if it declines to fulfil an Order for whatever reason, or if it is unable to fulfil an Order, whether it is within 16diamonds.com’s control or not. Without limiting the generality of the foregoing, 16diamonds.com reserves the right to decline any Order, in its sole and absolute opinion, which 16diamonds.com considers unreliable or improper, or suspect to be fraudulent or illegal upon checking the payment details submitted for that particular Order.

2.5

Access to the Website is gained through the use of a personal password designated to you under your Account. 16diamonds.com shall not be responsible for any online or offline password management and you shall ensure that your password is kept strictly confidential to prevent unauthorised use. 16diamonds.com shall not be liable for any claims, liabilities, losses, damages, costs and expenses whatsoever if any third party gains unauthorised access to and/or use of your password.

Order Placement

2.6

To place an Order with 16diamonds.com, please follow the steps below:

(a)

browse all the products on the Website;

(b)

select the products that you would like to purchase;

(c)

add the selected products to the shopping cart;

(d)

please check the item and press “continue shopping” or “check out”

(e)

”Continue Shopping” will lead you back to the shopping process to add more products to your shopping cart;

(f)

upon completion of all your selections, please proceed to view your shopping cart and click the ”check out” box;

(g)

You need to fill in the form with all particulars which 16diamonds.com may need to collect to generate an invoice, e.g. name, address, telephone number, e-mail address etc. fields. After filling such particulars please proceed by clicking the ”submit” button; and

(h)

Select your mode of payment from the menu provided. 16diamonds.com shall then process the payment through your selected and entrusted payment bank or service provider.

Order Status

2.7

16diamonds.com will provide you with the shipment details of the Products, including the air-way bill number. You may check your Order status with the courier's website through the courier’s online parcel tracking system or by contacting us via email at support@16diamonds.com.

2.8

You acknowledge that we do not guarantee a delivery date and on the rare occasion that there is a delay in shipment, the Products may not arrive within the estimate time.

2.9

The Products may be kept at the post office due to delivery difficulties (such as incomplete address). In such case, please make an enquiry with your local post office or the customs department.

2.10

3. Payment

3.1

16diamonds.com accepts various methods of payment for the Products including wire transfer, credit/debit card payment and cheque payment (for local purchases). [Please note that payment, regardless of the method used, must be made before the Products are shipped.] In terms of credit card payments, 16diamonds.com accepts major credit cards, including Visa and Mastercard. Upon acceptance of the Order, 16diamonds.com will issue you an invoice of the Order and if you pay by credit/debit card, your credit/debit card will be charged for the full Order amount, including shipping charges (if applicable).

3.2

There is no surcharge for using your credit card to make purchases with .16diamonds.com. Please provide your accurate billing address and telephone number (as they appear on your credit card statement). Incorrect information may cause a delay in processing the Order or failure to complete the Order request.

3.3

Please note that banks may levy some charges in accordance with their own policies. In case of return of Products, these charges are to be borne by you.

3.4

In placing an Order, you shall provide 16diamonds.com with accurate and complete payment information, and represent and warrant to 16diamonds.com that the use of your credit card or any other selected payment method, the details of which have been supplied to 16diamonds.com, is authorised and legal. 16diamonds.com has the sole and absolute discretion to refuse, decline and/or terminate an Order. 16diamonds.com reserves the right to cancel, delay, refuse to ship, or recall from the shipper any Order if your credit card information or any information relating to your selected methods of payment cannot be verified by 16diamonds.com.

4. Decline Orders

4.1

16diamonds.com reserves all rights to decline any Orders which contain incomplete or incorrect contact details and which do not pass 16diamonds.com’s address verification process. You may be asked to submit a recent bank statement or personal utility bill for the purpose of verifying your name, address and postcode, which will be used for your invoice details.

4.2

If there is an error in the description or price of the Product on the Website, .16diamonds.com reserves the right to supply the Products at the correct price. If such error occurs, you may wish to reconsider and cancel the Order.  If the Order has been executed and shipped out, then you agree to return the Product or pay the amount equal to the difference in prices invoiced to you. 4.3

Please note that all the prices stated on the Website are final and not subject to any negotiation.

5. Delayed Shipment

5.1

16diamonds.com shall make every attempt to fill all Orders placed and accepted. Notwithstanding this, some Products may be delayed because of shipment arrangement [or backorders]. If this is the case, .16diamonds.com will send you a notification via e-mail.

5.2

If [Products are backordered or if] there is delayed shipment, there will be no increase in the total shipping and handling charges and the Products will shipped pursuant to .16diamonds.com’s normal courier arrangements.

5.3

If you do not wish to wait due to the shipment delay [or backorder], you may request a cancellation for your Order via email at,support@16diamonds.com which is subject to .16diamonds.com’s cancellation policy. If 16diamonds.com does not receive a cancellation order from you, 16diamonds.com will assume you have agreed to the shipment delay.

5.4

16diamonds.com has a refund policy for a Product which has been out of stock for 6 consecutive weeks. In such case, 16diamonds.com may refund the full amount of the purchase price to you at its absolute discretion.

5.5

If you are interested in a piece of jewelry which is a repeat order [or backorder], please contact .16diamonds.com’s Customer Service Department via email at support@16diamonds.com or consultants who will provide you with an update on availability and the relevant prices via email. This may happen if, due to whatever reason, the selected Product is out of stock; the Website is not updated, or if there is a huge demand of the same, which may result in stock-depletion and/or unavailability.

6. Cancellation of an Order

6.1

To request cancellation of an Order or a Product, please send an e-mail to support@16diamonds.com’s Customer Service Department at. support@16diamonds.com

6.2

16diamonds.com does not guarantee acceptance of a cancellation since Product(s) may already be in the process of production or have been placed with .16diamonds.com’s inventory department or warehouse for shipment. Without prejudice to the foregoing, you may only make a cancellation request for Orders that are “In Processing”.

6.3

Cancellation if accepted, may take up to 21 business days to process from the date of your request.

6.4

In the event of cancellation of an Order, the payment processing bank may charge a processing fee. Such fee shall be charged to your credit/debit card and will not be refunded.

7. Return and Exchange

7.1

16diamonds.com reserves all rights with respect of any return of Products. For the avoidance of doubt, no return is acceptable without the authorisation of 16diamonds.com. All requests for return must be made within 14 days of receipt of the Product(s).

7.2

The packaging of your returned Product must be unused, or it will not be accepted for return unless) the Product is faulty by 16diamonds.com’s error.

7.3

Your Product must be returned with original packaging included original packaging materials, certificates (including diamond certificates pursuant to Condition 13.5 of these Conditions), guarantee letters and courier envelope / carton box with the airway bill number intact.

7.4

Prior to returning your Product, please e-mail to our Customer Service Department at support@16diamonds.com to request a replacement and obtain a Return Code Number.

7.5

If the returned Product is faulty by our error, a replacement will be made. In such case, 16diamonds.com shall send you a notification via email. There will be no cost of replacement Products nor any charges with respect to shipping and the handling process. Please note that it may take up to 2 to 3 weeks for 16diamonds.com to replace a Product.

7.6

Please note that it takes 16diamonds.com 14 business days to process returns of loose diamonds and 21 business days to process returns of jewellery after the relevant Product is in receipt at 16diamonds.com’s office.

7.7

All returns and exchanges must have a Return Code Number. Returns may be subject to restocking fee and handling fees. To obtain a Return Code Number, please e-mail to our Customer Service Department at support@16diamonds.com. Without prejudice to the provisions of this Clause 7, .16diamonds.com may accept an unconditional exchange for shipments of loose diamonds.

7.8

16diamonds.com may reject any return or exchange if the Product does not meet the conditions required for returns or exchanges. All return shipments must be insured and are made at your own expense unless authorised in writing by 16diamonds.com’s Customer Service Department.

7.9

Please fill out the return section of the Return Form completely and enclose it with the Product(s) you are returning. If you are exchanging Product (which should be of the same value as the original selected Product), please fill out the Exchange Product Form.

7.10

The original shipping and handling charges are not refundable. If you have an exchange for the same dollar amount as the original order, no additional shipping and handling charges will be incurred.

7.11

For returns, the process clients need to follow below details.

For return shipment

-

Client is required to use the same courier for returning the shipment, from which they received our goods shipment only. They cannot send us the shipment using other couriers, which will be not accepted.

The shipment must be prepaid by the Client unless pre-authorized received from our Customer Service Department)

The goods must be well-packed carefully as to avoid any damages in transit.

The original Packaging, Original Invoice provided by us and the Valid Grading Certificate has to be returned back with the goods.

7.12

No return or exchange is permissible on sale items or promotional items.

7.13

If you purchase a Product through 16diamonds.com’s designated agents, then the return of such Product will not be entertained b 16diamonds.com. In such case, you will need to approach the same agent which was responsible for your purchase, who shall liaise with 16diamonds.com in relation to all after-sales matters.

8. Defects and Claims

 

Please let us know all defects of your Product within 2 business days from the day you received the Product. Upon provision of evidence (e.g. pictures), 16diamonds.com may arrange replacement or credit towards your next purchase. 16diamonds.com reserves its right to decide the validity of your claims as well as the mode of compensation, if any.

9. Shipping and Delivery

9.1

16diamonds.com shall use the following couriers to deliver the Products to you:

(i)

FedEx;

(ii)

Malca Amit;

(iii)

Speedpost;

(iv)

EMS; and

(v)

Brinks.

The choice of courier depends on the value of the Product and the destination country/area of delivery. Notwithstanding the foregoing, 16diamonds.com shall have the sole and absolute discretion to choose the courier for delivery of all Products.

9.2

Please note that there will be no deliveries to P.O. boxes.

9.3

16diamonds.com provides a worldwide delivery service and shipment shall take approximately 5 business days for loose diamonds and 7-10 business days for jewellery upon receipt of payment (special orders excepted).

9.4

Expected transit time:

(i)

Local and Asia: 14 business days after shipping

(ii)

International: 28 business days

9.5

When you place an Order, 16diamonds.com will estimate shipping and delivery dates for you based on the availability of your Product(s) and the Delivery Address. The estimate shipping date will be shown in your order form. After placing the Order, you will find both the estimate shipping and delivery dates in the Order confirmation by e-mail.

9.6

While 16diamonds.com shall make every effort to deliver the Products on time, there may be unexpected delays in production. Please note that shipping and delivery dates are for indication purposes only and are not guaranteed.

9.7

The title to a Product passes from 16diamonds.com to you upon the Product being delivered to you. 16diamonds.com shall not be liable for any loss or delay due to incorrect or invalid information supplied to us. 16diamonds.com shall also not be liable for carriers’ delay or damage in transit. Any loss, destruction of or damage to a Product after risk has passed to you will not release or exonerate you from your obligations under these Conditions.

10. Shipping and Handling Rates

10.1

There shall be no charge for shipment of Products if the amount of the Orders exceeds USD3000.

10.2

For any shipment of an Order below the value of USD3000, please refer to the shipment charges as specified in Appendix A.

10.3

All rates and handling charges do not include any duties / taxes. You are liable to pay any land / custom duties and taxes and any charges levied by a country’s customs department. You will be solely responsible for such matters. You should contact your local customs department and other relevant authorities for further information.

10.4

Any additional carrier’s collection fee additional to the shipping charges is to be borne by you.

10.5

11. For shipments of Products that are backordered

 

16diamonds.com shall treat these as standard orders and the shipment of such Products shall remain unchanged.

12. Overseas Customer

 

Any Order being shipped to a destination outside Hong Kong is subject to import duties and taxes that are levied and collected during checkout. When placing an Order on the Website, you are considered the importer of record and must comply with all applicable laws and regulations. Charges for duties, taxes, and the carrier’s collection fee are in addition to your shipping charge and must be borne by you. You should contact your local customs office for further information.

13. Technical Requirements

For Loose Diamonds and Jewelry

13.1

16diamonds.com’s will inform you of details about your prospective purchases in as much detail as possible so that you can view the beauty, shape, colour, size etc. of your Product. In compliance with the industry standards and regulations (16.diamonds.com), please note that the carat weight may vary from 0.01-0.05 carats from the stated weight.

13.2

While 16diamonds.com has made attempts to inform the size measurement of all its Products, you acknowledge that during the manufacturing of the Products some variation may occur.

13.3

For all the diamond jewelry sets with multiple diamonds, 16diamonds.com shall make efforts to inform you in relation to the aspects of carat weight either as average or as minimum carat weight. However, please note that the colour and clarity grades are specified by .16diamonds.com in terms of an average or a minimum. The minimum term refers to all the diamonds that pertain to that piece of jewelry set that are either of the same quality or above the same quality. Similarly, the average term refers to those collective diamonds in that piece of jewelry that are all either equal to that grade or exceed the same grade as specified by.16diamonds.com.

13.4

Further, please note that because settings on individual monitors may vary, it is difficult for .16diamonds.com to show the exact colour(s), size of each Product. All images have been optimised to look their best on variety of different platforms, browsers and monitors. 13.5

Diamond Certificates and Charges (Diamond Related Each Order placed for loose diamond is shipped with a valid grading report, also known as a “diamond certificate”. Such diamond certificate is based on inspection and obtained from diamond certifying laboratories at a cost. In case of any return of the loose diamond, you must include the diamond certificate which accompanied the Products to be sent back with the returned Products. Otherwise a charge of USD250.00 will be levied for missing original diamond certificate.

13.6

Comparative Purchasing

16diamonds.com does not entertain any comparative purchasing, wherein you purchase and receive the Order shipment, but later decide to return the relevant Product(s). Since this involves re-stocking, inventory overhead and processing time, .16diamonds.com recommends that you carefully consider by purchasing the relevant Product(s). 14. Liability

14.1

16diamonds.com warrants that the Products shall be of satisfactory quality and free from defects in design, material and workmanship at the time of delivery.  All other conditions, warranties and representations (except those set out in these Conditions) are excluded to the fullest extent permitted by law.

14.2

16diamonds.com’s only obligation in relation to defective Products shall be at its option to make good any shortage or non‑delivery and/or to replace any Products found to be damaged or defective and/or to refund the cost of such Products to you.

14.3

Subject to Condition 14.5, 16diamonds.com’s aggregate liability to you whether for negligence, breach of contract, misrepresentation or otherwise shall in no circumstance exceed the price paid by you for the relevant Products in respect of any occurrence or series of occurrences

14.4

Subject to Condition 14.5,  16diamonds.com shall not be liable to you:

14.4.1

for defects in the Products caused by abnormal or unsuitable conditions of storage or arising from any drawing, design or specification supplied by or any use by you or any other third party;

14.4.2

(except as otherwise agreed) unless you, with 16diamonds.com’s prior authorisation, returns alleged damaged Products to .16diamonds.com or makes any damaged Products (including packaging material) available to 16diamonds.com for examination;

14.4.3

if the total price for the Products has not been paid;

14.4.4

for any loss or damage unless notified to 16diamonds.com in writing within 2 business days of delivery of the Products or where the defect would not be apparent on reasonable inspection within [5] business days after any latent defect in the Products becomes apparent; or

14.4.5

For any indirect or consequential loss or damage or loss of profit, revenue or goodwill suffered by you, howsoever caused.

14.5

Nothing in these Conditions shall exclude or limit .16diamonds.com’s liability for death or personal injury caused by .16diamonds.com’s negligence or for loss or damage caused by 16diamonds.com’s fraud.

15. Indemnity

15.1

You shall indemnify.16diamonds.com in full against all liability, loss, damages, costs and expenses (including legal expenses on an indemnity basis) awarded against or incurred or paid by .16diamonds.com as a result of or in connection with:

15.1.1

the breach by you of any term of these Conditions;

15.1.2

any wilful or negligent act or omission by you; and/or

15.1.3

16diamonds.com’s reliance on any specification, instruction, information, intellectual property, material or documentation supplied by you which is inaccurate or infringes the rights of any third party.

16. Force Majeure

16.1

16diamonds.com shall not be liable for any non performance of its obligations under these Conditions if it is as a result of circumstances which are beyond its reasonable control, provided that as soon as is reasonably practicable it gives notice to you of such circumstances.

17. Governing Law

17.1

The laws of Hong Kong shall govern these Conditions.  The parties submit to the exclusive jurisdiction of the courts of Hong Kong.

18. General

18.1

If any provision of these Conditions is found under the laws of any jurisdiction to be invalid, illegal or unenforceable, the invalidity, illegality or unenforceability of that provision in that jurisdiction shall not in any way affect the other provisions of these Conditions in that jurisdiction and shall not affect the validity, legality or enforceability of all the provisions of these Conditions in any other jurisdiction.

18.2

No failure or delay by either party to exercise any right or remedy under these Conditions shall be construed or operate as a waiver of that right or remedy, nor shall any single or partial exercise of any right or remedy preclude the further exercise of that right or remedy. The rights and remedies provided in these Conditions are cumulative and are not exclusive of any rights or remedies provided by law.

18.3

Nothing in these Conditions creates a partnership or employment relationship between the parties, or (unless stated otherwise) makes one party the agent of the other.

18.4

These Conditions and the documents they refer to represent the entire terms agreed between the parties in relation to their subject matter and supersede all previous contracts and arrangements of any kind between the parties relating to its subject matter.
